Alimony

Illinois does not base spousal support on who is at fault, but rather is calculated based on several factors including specific financial needs, current income and assets, standard of living and length of marriage.

Trusts, Living Trusts and Wills

It is important to ensure the future of your family is secure. Providing financial security for your family following your death is one of the most crucial steps you can take, no matter your age.  Creating a will that specifies your beneficiaries and guardians of your minor children is a key aspect of estate planning. Trusts allow property to be distributed directly to your beneficiaries following your death without being subject to probate while Living Trusts provides for yourself near the end of life while specifying what will happen in case of mental or physical incapacitation, as well as how your estate will be handled upon death.

Child Custody and Child Support

Child custody is one of the most important issues in your divorce. Illinois Courts decide many of these cases with the best interests of the children in mind. The cooperation of both parents is encouraged, but not always required and doesn’t mean joint custody. A judge considers many factors including:

  • Criminal and psychological history of both parents
  • The child’s wishes, if they are mature enough to have a say
  • The overall stability of the home
  • If parents are seeking to remarry or live with a new partner

No matter how easy or contentious your divorce is, you may have a financial obligation to help care for your child or children. This should be your first responsibility and should never be used as leverage against your ex-spouse, nor should your ex-spouse seek more than what is necessary to maintain your child’s way of life.

In Illinois, the minimum amount of child support that should be paid is based on the number of children and their financial needs. Generally, this is 20% of the supporting parent’s net income for one child and can go as high as 50% for six or more children.

Determining monthly payments is often more complicated than what the online calculators will show you. There are many factors a calculator cannot account for. You need a skilled attorney that can help ensure your children get the support they need, but that your interest is also protected.

Prenuptial Agreements

A prenuptial agreement is a legal agreement made before marriage between both spouses. This agreement determines how assets, debts, and many other financial matters will be handled should a divorce occur. While these agreements generally have a very negative connotation, having a prenuptial agreement in place can help you avoid serious and costly disputes in the future.

I understand the sensitive nature of finalizing a prenuptial agreement. Getting you potential spouse to agree to the terms and condition in the agreement can be very difficult. I will make sure to approach the subject with the goal of making the process comfortable and acceptable for both parties.
